The Issue

We are calling for an immediate investigation and intervention into San Eli Supermarket located in Fabens, Texas. This grocery store has continuously endangered public health by selling expired, moldy, and improperly stored food while charging excessive prices.

 


Numerous residents have documented and shared disturbing findings such as:


Mold-covered pan dulce and bread being sold straight off the shelves
Packaged meat with foul smells, slime, and discoloration
Milk that is expired or already spoiled by the time it reaches the customer even before the printed expiration date
Refrigeration units that have not been replaced or repaired since the store operated as Big 8 decades ago
Severely overpriced items especially produce and meat with prices comparable to high-end organic grocery stores
Dangerous items sold to families with children, immunocompromised individuals, and elderly residents

 

 


Despite this, San Eli has continued operating and appears to receive passing health scores on posted inspections. Yet when residents contact the El Paso Department of Public Health, we are told that Fabens is not under their jurisdiction.

 


This raises serious questions.

Who is overseeing them if not El Paso County Health?

Why are they allowed to keep operating under these conditions?

How are they getting near-perfect scores while selling visibly spoiled food?

 


This is not just gross or inconvenient it is dangerous and illegal.

According to the Texas Food Establishment Rules (TFER):

 


Food must be safe, unadulterated, and honestly presented (TFER § 228.61)
Expired or spoiled items must be removed and destroyed (TFER § 228.73)
Cold foods must be stored at 41°F or lower which has been visibly violated

 

 


San Eli is exploiting its monopoly in Fabens where many residents do not have the transportation or resources to shop in nearby towns. For some families this is the only place within walking distance to buy groceries and they are being forced to choose between hunger and spoiled food.

 


This is systemic neglect and consumer abuse.

This is a public health risk.

This is an environmental hazard and a moral failure.

 


We demand the following:

 


An official on-site health inspection from the correct authority
Immediate temporary closure until standards are met
Transparency about jurisdiction, licensing, and past violations
Legal action if negligence or fraud is confirmed

 

 


Let us protect our community. Let us protect our children. Let us stop pretending this is acceptable.
