The Issue

Don’t BAN Marijuana Edibles in Colorado!

Colorado State Representatives Frank McNulty and Jonathon Singer have introduced a bill, HB 1366, that mandates what size, shape, and color your marijuana edibles can look like.  

Please sign this petition to tell the lawmakers and the Governor of Colorado that there are currently enough protections through the Marijuana Child Resistant Packaging regulations in place to prevent accidental ingestions, and that this bill is simply a BAN on your FREEDOM TO CHOOSE what products you are able to buy.

Please also take the time to contact the members of the House Health, Insurance, and Environment Committee to tell them that Frank McNulty and Jonathan Singer got it wrong, and that this bill is nothing more than a BAN ON EDIBLES.

Call them or write to them, and tell these legislators that you are a responsible, legal-age adult who has the right to buy the edibles products you want, and to stop trampling on your right to access to marijuana products.

Tell them that they work for you, and that you will vote against any legislator who does not respect your rights.

Following is the language of the petition:

Dear Governor Hickenlooper and members of the Colorado General Assembly:

Marijuana Edibles and marijuana products are a constitutional right in the State of Colorado.  The Colorado Constitution states that marijuana and marijuana products are a right for Citizens and visitors to Colorado who are 21 years and older, and that these products are to be regulated in a manner similar to alcohol.

Marijuana-infused edibles are no different from alcohol-infused edibles and confections, since alcohol candies are readily available for purchase by legal-age adults in any store that sells alcohol, and therefore SHOULD NOT be regulated in a manner different from these products.

This legislation mandates that marijuana infused products should somehow all be made the same so that they can be identified out of the package.  Products that are not meant for consumption by children (like marijuana, alcohol, prescription drugs, and hazardous substances) are required to be in specific packaging, but there are no rules or laws about any other product that mandate how they look out of the package, because that is not a practical standard that consumers of these products will accept.

Child-Resistant Packaging and consumer responsibility are the most effective tools to prevent accidental ingestions; and it’s working.  Not one of the cases of accidental ingestions of marijuana products by children have been found to be from commercially-made products sold at licensed and regulated dispensaries, therefore, there is no reason to mandate a shape, size, or color of marijuana edibles.

The measure in HB 14-1366 is simply unnecessary, unconstitutional, and not based in reality. The products that are regulated and manufactured by licensed businesses are not falling into the hands of children.  The products that are not regulated and packaged according to law are what is causing accidental ingestion, and the focus of the State of Colorado should be on educating the public about marijuana packaging and responsible storage of marijuana products made at home instead.

I am signing this petition to ask you to VOTE NO on HB 14-1366 and reject the attempt to prohibit my access to products that are my constitutional right to purchase, possess, and consume.
