Close the Loophole in Elder Abuse Investigations

The Issue

I witnessed the family of an elderly person report serious concerns to the Office of the Public Guardian (OPG) and social care, triggering an investigation into potential elder and financial abuse by someone entrusted with Power of Attorney. Tragically, after the individual was returned to the care of the person they had raised concerns about, they passed away—and the investigation was abruptly closed. No accountability. No answers. No justice. No closure.

This should never be allowed to happen. The law must change so others don’t suffer the same injustice.

In many cases, vulnerable elderly individuals or their families report abuse, fraud, or exploitation, only for investigations to be halted prematurely if the victim dies. This current legal loophole allows perpetrators to escape justice, leaving families in turmoil and without the closure they desperately need. According to the Office of National Statistics, financial abuse is one of the fastest-growing forms of elder abuse, affecting hundreds of thousands of seniors annually in the UK.

Changing this aspect of the law would ensure that investigations into allegations of abuse or financial exploitation do not simply vanish when a victim dies. Instead, the process should continue, with evidence gathered being passed to law enforcement where necessary. By closing this loophole, not only will justice be served, but it will act as a strong deterrent to potential abusers, upholding the rights and dignity of our elderly population.

Allowing investigations to persist after the death of a victim would send a clear message: Justice will not die with the victim. The legal system must prioritise the well-being and protection of the elderly, providing transparency and answers to families who have already suffered enough. Let's push for changes in OPG policies and provide unending protection to our elders.
