Close Manslaughter Loophole in New Mexico Law
The Issue
New Mexico law allows murderers to claim self defense against their victims to get a lesser sentence. The Tyler Lackey Memorial Bill (SB 363) will close this loophole. It will amend New Mexico law to preclude a defendant charged with homicide from receiving a jury instruction for a lesser manslaughter charge if the defendant was “in the course of or during an escape from the commission of a felony offense, or while resisting a lawful arrest by a law enforcement officer or another person."
