Close Legal Loophole: Charge Unauthorized NJ Constables

The Issue

On July 17, 2024, my dog Paris was unjustly taken from us — not by accident, but by a failure in our legal system. A constable, acting outside the bounds of state law, trespassed onto our private property in Tabernacle, New Jersey, and caused irreversible harm to our family.

Despite the emotional toll this has taken on us, this event highlighted a critical issue in New Jersey's legal framework. Since January 1, 2021, constables have not been authorized to serve court papers, make arrests, or act in any enforcement capacity within the state. However, many constables continue to operate under the guise of authority, often impersonating legitimate police officers, without facing any consequences for these actions.

The current legal framework in New Jersey lacks necessary enforcement mechanisms and penalties to prevent constables from impersonating law enforcement officials. This oversight not only jeopardizes the safety and trust of its residents but also undermines the integrity of our legal system. Each time a constable acts outside the law, they erode public trust and threaten the safety of our communities.

To rectify this issue, we urge state lawmakers and legal authorities in New Jersey to close this loophole by introducing strict penalties for constables who exceed their legal capacities. Enforcing legal boundaries is essential to uphold justice and restore trust in our system. Constables who act outside the law should face immediate charges of impersonating a police officer, with appropriate legal repercussions to deter future offenses.

Legislative action can ensure that no family has to endure the trauma and violation we experienced. It's time for New Jersey to act decisively and protect its residents from unlawful impersonations that exploit trust and authority.
