The Issue
My name is Joshua Donavan I am 30yrs old and I was only 20 years old when I took a plea for 240 months, a first time offender, no other priors and non violent. I have served 11 years of my 240-month sentence for conspiracy to distribute oxycodone "resulting in a death" and distribution of oxycodone. My case stems from a 6 month period in which I sold one person 100 oxycodone pills every 2 weeks from August 2009- February 2010. Which amounted to 1200 pills. It should have been a federal sentence of 46-57 months, but with the death resulting it called for 240 months, which my co-defendant and myself received. The co-defendant was later resentenced to 157 months and is eligible to go to the halfway house in 2021. I will not be eligible until 2027. Toxicology and autopsy reports show that Mr. Evin's immediate cause of death was " oxycodone AND cocaine intoxication", not just the oxycodone.
I take full responsibility of my crime, my actions and understand that I was suppose to go to prison and I am so remorseful for the pain I have caused to Mr. Evin's family and my family. This sentence is outrageous due to federal minimum mandatory laws. A 20-year sentence is unduly harsh and disproportionate. I have put in two motions to have a sentence reduction and every motion has been denied. Prosecutor will not reduce my sentence. I suffer from asthma and was denied compassionate release from my sentencing Judge Shadid.
Since I have been incarcerated I have done everything I can do to better myself as a man and as a law abiding citizen. I have worked himself way all the way down to minimum security status, I am currently volunteering in the Federal Prison Camp in Marianna Florida helping rebuild the Medium Security Federal Correctional Institution that was damaged in the hurricane in 2018. I have been clean from drugs and alcohol for the whole 10 years I has been incarcerated and have passed many drug and alcohol tests. Completed many classes over the years including my GED and multiple drug classes. I am not been eligible for many of the Vocational Training courses because of the remaining time on my sentence. Also when I was at FCI Pollock I taught a Anger Management class and Parenting class. I have helped inmates study and pass their GED. When I am released I would like to get my CDL and pursue a career in that field of work. Also I would like to get involved with my community and talk to at risk kids, help them understand that the life of drugs and gangs is not a way of life. That it only has negative effects on you, your family and nothing good can come from it. I have a stable release residence with me my fiancé and with my 4 step-kids who I love as my own. They have already accepted me into our family and wish for me to be home with them as well. The probation for the Central District Of Illinois has already approved my residence for my release when they did a home visit when I filed for Compassionate Release due to the COVID-19 Virus because of my asthma condition.
