We call upon the City of Cape Town’s Spatial Planning department as well as the Municipal Planning Tribunal to impose the maximum penalty on serial offenders who repeatedly and deliberately violate the Development Management Scheme by-law provisions for the sole purpose of profiteering by creating slum apartments within Ysterplaat, Brooklyn & Rugby suburbs. We have noted with alarm at how our once peaceful neighborhoods have now become the playgrounds of illegal constructions owned by Slumlords who manipulate and exploit the leniency demonstrated by Municipal Planning Tribal when determining the appropriate Administrative Penalty. We therefore call on the City of Cape Town and more specifically the Municipal Planning Tribunal to exercise default decisions on serial offenders to an amount no less than 100% the Administrative Penalty Calculation as is allowable in terms of section 129(7)(a) of the by-law or else enforce an order for demolition of such illegal constructions.

Administrative actions that do not impose the highest penalty on violations of the Development Management Scheme by serial offending Slumlords, lends encouragement for the Slumlords to continue in their unlawful conduct, as they know that the moneys they receive from ‘tenant stuffing’ will supersede any lenient penalties traditionally doled out by the tribunal. Here the Slumlords regard the lenient  Administrative Penalty as just another cost of doing business, absent any regard on how neighbors are negatively effected.

There probably is no better illustration of how penalty leniency by Municipal Planning Tribal is being exploited by serial illegal building offenders than one Clifton Felix Eden who owns at least 15 properties within the three borrows of Ysterplaat, Brooklyn and Rugby. Public records show that this individual received Administrative Penalties on at least 3 of these properties dating back between 2009 till 2019, for offenses ranging from unlawful building works to unauthorized alterations. The total Administrative Penalty Calculated altogether and which the Municipal Planning Tribunal panel ‘could have’ imposed on his repetitive violations was R642,333.20 but instead, this individual only received a total of R32,638.90, a mere 5% total of what the tribunal has the powers to impose.                

The latest property in this particular serial offender’s unlawful building alterations, with the probable profiteering goal of ‘tenant stuffing’ is No. 4 Farnworth Street, Rugby. Here, yet another unauthorized alteration is underway despite the building inspectors issuing a desist notice, the owner of the property, Clifton Felix Eden, has ignored the notices and continued with completion of the illegal alteration. Our call as an affected community, is one that says ENOUGH is ENOUGH. And it is on this basis that we post this petition to demonstrate to the Tribunal that the affected communities have had utterly enough of lawlessness within the three borrows of Ysterplaat, Brooklyn & Rugby. We ask you the Municipal Planning Tribunal panel to respond back to our collective cry to end lawlessness by imposing the highest penalty on lawless Slumlords by issuing an order to demolish the unlawfully built structure on No. 4 Farnworth Street, Rugby. To action less than this collective request would be the same as colluding with Slumlords exploitative profiteering goals. We know and trust that you Municipal Planning Tribunal (unless proven otherwise), are on the side of law abiding citizens, and so we ask you too to demonstrate that ENOUGH is ENOUGH!
