The Issue
Petition for Fair and Equitable Child Support Reform
We, the undersigned, call for a comprehensive restructuring of child support laws to ensure fairness, equity, and the well-being of all children involved in child support arrangements. Current laws often fail to adequately account for all children a noncustodial parent supports, resulting in financial hardship and inequality. We believe child support should be focused on the children’s needs, not as a punishment for the failure of relationships or to equalize incomes between parents.
The Issues We Seek to Address:
- Equitable Financial Support for All Children:
Child support calculations should include all of a noncustodial parent's children, both inside and outside the home. Currently, child support obligations only consider children outside the home, often ignoring the financial needs of children the noncustodial parent shares with other people. This approach creates an imbalance where noncustodial parent may struggle to meet the needs of their children within their home, while also fulfilling child support obligations for children outside the home. - Fair Division of Child Support Payments: We propose that child support obligations be divided evenly among all of a noncustodial parent's children, ensuring that no child is deprived of financial support due to the existence of other children requiring support. Every child deserves financial support regardless of their living situation, and this system should ensure that all children benefit equally.
- Equal Financial Responsibility of Parents:
A noncustodial parent's current spouse should not be financially burdened by the needs of children outside the home to a greater extent than the custodial parent of children outside the home. The financial obligation to children should be shared equitably between both parents. The spouse should not bear additional financial responsibility for joint children with the noncustodial parent, especially if the custodial parent of the children outside the home is not required to contribute to their joint children equally. - Child Support Should Focus on Children, Not Punishment for Failed Relationships:
Child support is meant to benefit the children and ensure their well-being, not to penalize parents for their failed relationships. It should not be used as a tool to equalize incomes between parents, but rather as a means to ensure that children receive adequate financial support, regardless of the circumstances surrounding their parents' relationships. - Limiting the Percentage of Income Taken for Child Support:
We propose that no more than a reasonable percentage (e.g., 25% of the non-custodial parent's income) should be taken for child support, ensuring that non-custodial parents are able to maintain a reasonable standard of living while fulfilling their child support obligations. This will prevent excessive financial burden on the non-custodial parent, especially when supporting multiple children in different households.
Our Proposal:
We urge lawmakers to consider the following changes:
- Reform Child Support Calculations: Ensure that all of a noncustodial parent's children, both inside and outside the home, are accounted for equally in child support calculations.
- Fair Division of Support: Divide the financial obligation of child support equally among all of a noncustodial parent's children, ensuring no child is disadvantaged based on their living situation.
- Balance the Financial Burden: Ensure that both parents contribute equally to the financial well-being of the children they support.
- Focus on the Children’s Needs: Make sure that child support is focused solely on the financial needs of children, not as a punishment or tool to equalize parental incomes.
- Limit the Percentage of Income Taken for Child Support: Ensure that no more than a reasonable percentage of the non-custodial parent's income (e.g., 25%) is taken for child support to prevent undue financial strain.
Why This Is Important:
Essentially, the noncustodial parent's allotted amount to be used for child support, will be divided evenly among all of their children. This change will ensure that child support fulfills its intended purpose: to benefit the children by providing financial resources for their care and development. By ensuring fairness, we can create a system that supports all children equitably, respects the financial realities of families, and encourages cooperative co-parenting.
We call on our legislators to act now to address the inequities in child support laws and implement these reforms for the betterment of all children involved.
