We request that ALL physical evidence and ALL records of ANY kind be preserved and not purged or expunged from Mr. Andrew Kinyon's cleared/closed cold case file #72-0064053

MAINTAIN and RETAIN:

1) ALL physical evidence, including ANY and ALL clothing from the victim, ANY and ALL clothing and assorted items taken from the suspect, including boots and roofing knife.

2) ALL information, including but not limited to; ABO blood typing test results (pre-1990) and DNA test results that may have been conducted; ANY & ALL interviews including, but not limited to Mr. Andrew Kinyon's roommates at the time of his murder; ANY and ALL interviews with Mr. Andrew Kinyon's personal friends at the time of his murder; ANY and ALL witness statements, including eye-witnesses; ANY and ALL crime scene photos, interrogation recordings/transcripts, investigation notes, suspect rap sheet, and ALL related materials created by investigators.

THE REASON:

This request is made based on gross misinformation provided to Mr. Andrew Kinyon's family, and the family's strong suspicion that even more incriminating evidence is purposely being withheld by the San Francisco Police Department. We have evidence indicating that there may have been one or two accomplices to this murder who are being allowed to go unnamed and unpunished. 

January 22, 1972, Mr. Andrew Kinyon was murdered at 2:15am. Since his murder, the family has not been kept informed in a consistent manner to assure the family that all avenues have been investigated to build a case and prosecute the person(s) responsible for the murder of Mr. Andrew Kinyon.

Not long after the murder, the family was informed by Inspector Frank Falzon that homicide detectives were convinced that "Eugene Santore" (actual name; Eugene Imbrogno) was responsible for Mr. Andrew Kinyon's death, but without more evidence he said nothing could be done.

In 1984, Inspector Falzon notified the family that "Eugene Santore" (Eugene Imbrogno) had been convicted and incarcerated for a similar crime. It was stated by Inspector Falzon that Mr. Andrew Kinyon's family should take comfort in the knowledge that the man was in prison. As of this date, it's been determined that Eugene Imbrogno had never been in prison, nor had any charges ever been filed against this person for a crime similar to murder. In fact, Eugene Imbrogno actually died in 1984. The family was never notified of his death. For the next 30+ years they were led to believe the man was alive and in prison.

Throughout the years 1972-2020, Mr. Andrew Kinyon's relatives have pressed for answers to questions which they have posed, only to get no response. Requests to have DNA tests done on the suspect's knife and boots have been repeatedly denied since the early 1990s. In August 2020, following a request to review the cold case file in it's entirety, Sergeant Alan Levy stated that a court order would be required and that no additional information could be provided to the family.

Sergeant Alan Levy also stated, that at some point in 2018, without the knowledge of Mr. Andrew Kinyon's family, his cold case had been closed -- please understand, his family does not know why or under what circumstances that determination was made, or why they were not contacted about this development.

May we end this letter by stating, Mr. Andrew Kinyon was loved dearly by his family and by those who knew him. He was a devoted son to his parents, a kind and loving husband, and a doting father to two young children. Please understand that while this murder occurred in 1972, his absence in his family's life has been not only painful to the extreme, his son who was 9 years old and daughter who was 7, grew up without him. The loss of a father for his children, especially a son, can not be underestimated -- in fact it was and remains a most profound and staggering loss.

Mr. Andrew Kinyon's family is once again seeking assistance. We respectfully request that the cold case file not be destroyed. We request that the complete, full file be retained in its entirety AND that a serious comprehensive investigation be done.
