The Issue

For several months now, I have been harassed by the Charlotte Mecklenburg Police Department for engaging in busking, which is my primary source of income. Despite having sound permits, I have faced repeated confrontations with the police over alleged noise ordinance violations. On Sunday, December 21st, I experienced a distressing incident where I was arrested by Officers B.C. Lilley and Madison Guthrie. During the arrest, I was choked, and my head covering was forcibly removed and thrown to the ground. To make matters worse, the police unlawfully confiscated my drums and other equipment, significantly impacting my ability to earn a living.

Busking is a legitimate and legal form of artistic expression and livelihood. It enriches our community's cultural fabric and provides both artists and residents with vibrancy and engagement. The harassment and unjust treatment I have received not only infringes upon my personal rights but also sets a dangerous precedent that may affect other street performers and artists in Charlotte.

Numerous cities around the world celebrate and protect busking. Cities like New York, San Francisco, and Austin have recognized the importance of street performances and have crafted policies to support and regulate it positively. Charlotte, a city known for its thriving arts scene, should lead by example and foster an environment where artists can thrive without fear of harassment or undue punishment.

I am calling upon the Charlotte city council and the police department to review and revise their policies regarding busking and noise ordinances. We need clear, fair, and consistent guidelines that recognize the value of street performances, ensuring that artists have the freedom to express themselves within legal boundaries. Furthermore, there should be accountability and training for officers to respect and uphold these regulations, avoiding unnecessary confrontations and violations of artists' rights.
