Good Afternoon, Its been a while since we've updated our petition. We do have some developing news. In recent months, Hunter Burkhalter that presided over our son's Hearing we brought against HEBISD - has been fired from the State Office of Administrative Hearings for doing much of the same to others in another hearing that he did to us in our hearing for our son. Presently, Hunter Burkhalter is pleading to get his job back and asking that the Chief Administrative Law Judge not be re-appointed for having fired him. He has sent a letter to the Governor pleading for his job back. The grounds in which he was fired was due to bias and comments in his decision that were not supported by the record. Some of his comments were very offensive enough so that another state agency reported him to the Chief Administrative Law Judge of SOAH in Austin. He was let go - not for his decision, but because of his violating the Code of Conduct. What is interesting is that he acts as if this was the first time that he ever behaved that way and is defending his poor actions with a vengeance. I'm sure its been uncomfortable to lose his job, but this is NOT the first time he behaved this way. In our hearing alone, he violated the State Office of Administrative Hearings Code of Conduct several times. He was to immediately recuse himself from our hearing due to the fact that he was a student throughout his school years in the Hurst-Euless-Bedford ISD, K-12. Additionally, he was friends with one named in our complaint, Darla George Clark. It was Darla that kept our son from having been identified at all. Once Darla realized that we were pursuing identification after our son moved up to 7th grade in HEB in the next school, she began smearing our son to co-workers and poisoning the well so to speak. Burkhalter was sent in to preside over our hearing in Darla's defense and for the defense of HEBISD. I say sent in - as the FIRST Hearing Officer over IDEA Due Process ever. He was REQUIRED to not only recuse himself. We have ample evidence that he entirely ignored relevant evidence and allowed the Assistant Principal, Damon Emery's aggravated perjury to go into Federal Court on appeal. Emery's testimony was loaded with PROVABLE perjury, but Burkhalter did not care. We had asked for a Re-Hearing upon notice of AGGRAVATED perjury and he refused. Now that Burkhalter has been called out in another hearing for doing much of the same, he is giving the appearance that he has never done this. It is an appalling dishonest claim. The bias in his decision was off the scales in our son's hearing alone. HEBISD and Nona Matthews recruited Burkhalter to destroy our son in a very injurious false biased decision. We have the ability to still prove this to this very day. Once Burkhalter was recruited, he delivered. Now he attempted to do similar to others and others are not having it. Burkhalter is pleading for his job back. To the Texas Public School Children with Disabilities (up to 250,000) in this state that have been so grossly harmed by the recently lifted 8.5% Cap and TEA policies - we cannot allow bias and prejudiced hearing officers to be recruited to harm our children further. To add insult to injury in 2008 many families reached out to countless legislators in 2008 to transfer the TEA Hearings from TEA to the State Office of Administrative Hearings just to prevent exactly what Hunter Burkhalter did in our son's case. Even more appalling is that Burkhalter was the very first IDEA Hearing Officer with SOAH to preside over such a case with many conflicts of interest. With the recent lifting of the Illegal 8.5% Cap, we as parents and families have for the first time in years have something working in our favor, but we must do so much more and that is to continue to work to stop this horrific widespread corruption. We have to call out these attorneys such as Nona Matthews, all corruption and any Hearing Officer that is willing to be bought or persuaded to break rules and laws to give a win to any school district that has so grossly harmed our children.
