The Issue

I am a victim of malpractice. Three years ago, I had a surgery that changed my life. Only now, two weeks ago, did I discover that what I experienced was not just unfortunate but an act of malpractice. Sadly, the realization came too late as the statute of limitations has expired. I am now facing another surgery to correct the oversight that took place during my initial procedure.

This is a call to action to change the statute of limitations on malpractice cases. Currently, in many regions, a patient has only one year to realize that malpractice has occurred and a total of three years from the date of the original malpractice, irrespective of when it was discovered. This policy does not take into account the incredibly complex and sometimes slow nature of recognizing post-surgery complications or errors.

Medical procedures and outcomes can be difficult to navigate, and it often takes a long time for patients to recognize that what they are experiencing may not be a normal part of the healing process. This timeframe is simply insufficient and leaves countless victims like myself without recourse, further victimizing those already suffering from medical errors.

By extending the statute of limitations, we can ensure that more victims of malpractice have the opportunity to seek justice and have their cases heard. In many instances, symptoms do not manifest until much later, and it is only fair to allow patients a reasonable timeframe to discover that they have been wronged.

We urge lawmakers to consider revising the existing rules to better protect patients' rights. A plausible solution would be to extend the timeframe to a minimum of five years with a possibility for extension in cases where malpractice is discovered later. It is crucial to provide a fair opportunity for victims to seek the justice they deserve.
