The Issue

We, the undersigned, call on the UK Ministry of Justice and the Family Court system to urgently reform the process of granting Non-Molestation Orders (NMOs).

While NMOs are an essential protection for individuals at real risk of harm, they can also be granted ex-parte (without the other person present) based solely on a written statement. This often occurs without evidence being verified, and the respondent may receive less than 24 hours’ notice for a hearing that could severely impact their life.

We believe the following reforms are necessary:

1. Require supporting evidence wherever possible before granting an emergency NMO.
2. Ensure respondents have a fair notice period (minimum 3–7 days) except in genuine emergencies.
3. Introduce consequences for knowingly false statements to protect the integrity of the system.
4. Provide courts with clearer guidelines on assessing risk vs. insufficient evidence.

These changes will protect true victims, reduce misuse of the system, and ensure everyone has access to a fair and just process.

We ask the government to review and reform the procedures surrounding Non-Molestation Orders to promote safety, fairness, and accountability for all.
