The Issue
We are devastated to share that our beloved family dog has tragically been taken from us in a manner that we suspect involves foul play. After consulting legal experts, we were shocked to learn that the person we believe responsible, who we will refer to as 'X' to protect their identity during ongoing proceedings, would potentially face charges of only 'criminal damage' under the Criminal Damage Act 1971 and The Animal Welfare Act of 2006. This legal classification horribly underestimates the gravity of the situation and fails to acknowledge the emotional trauma inflicted on families and communities alike.
The current laws, while meant to protect property, do not adequately address the emotional bond and the intrinsic value of life our pets hold for us. For many, animals are seen not merely as property but as family members and companions. Applying a simple 'criminal damage' charge in cases of deliberate and malicious harm or killing of animals is unjust. It minimizes their importance in our lives and offers inadequate legal consequences for the offenders.
Around 44% of UK households have pets, showing how integrally animals are a part of British families. Animals are loving, sentient beings who deserve their own rightful protection under the law. Treating their unjust killing with the same gravity as other forms of extreme cruelty is imperative.
We urge lawmakers to amend existing legislation, enhancing the protection given to animals by recognizing deliberate harm and killing as 'extreme animal cruelty.' The revision should include harsher penalties that reflect the moral and societal importance of the lives of animals, including imprisonment and significant fines, to act as a deterrent against such heinous acts.
