The Issue

In Colorado, my children were subjected to abuse by their biological father as newborns. Despite a preponderance of evidence proving the abuse, the lack of physical harm resulted in a mere misdemeanor conviction. This heart-wrenching experience has revealed a major flaw in our legal system: the inability to adequately protect and serve justice for non-verbal victims who cannot testify or articulate their abuse.

In countless cases, children who cannot speak—whether due to age, developmental disabilities, or other factors—have their traumatic experiences overlooked or diminished within the legal framework. Current Colorado laws fall short in delivering justice to these vulnerable individuals, allowing abusers to face minimal consequences for potentially life-altering harm.

Statistics show that child abuse affects approximately one in seven children in the United States. Many of these victims cannot voice their suffering. Moreover, Colorado has seen a rise in child abuse cases where the victims are unable to physically or verbally communicate their trauma, leaving their cries for help unheard.

The Colorado legal system must evolve to acknowledge that absence of physical harm does not equate to absence of trauma. This requires a comprehensive reassessment and enactment of legislation that recognizes the plight of non-verbal victims and imposes stricter penalties on abusers, ensuring that justice is served not only in cases with visible injuries but also those where scars run unseen, deep within.

Proposed solutions include:
1. Implementing specialized training for law enforcement and legal professionals to recognize and handle cases involving non-verbal child abuse victims effectively.
2. Developing a protocol for gathering and presenting evidence in the absence of victim testimonies, using expert witnesses like child psychologists and pediatricians.
3. Enhancing penalties for child abuse when evidence clearly indicates abuse, even in the absence of physical harm, to ensure they reflect the severity of the crime.
