Change California Law for juvenile murderers
The Issue
On Wednesday, July 20th 2022 at approximately 9 pm my nephew Damien Estrada was shot on the back of his head by a 17 year old male for no reason whatsoever other than he was in National City territory and this minor is a known and documented gang member from Paradise Hills.
After 8 days on life support my brother Carlos and sister in law Rosa had to make the most painful decision of their lives, which was to take their child off life support. Damien died on Thursday, July 28th 2022. He was only 16 years old and our lives changed forever.
This minor was arrested in Sept of 2022 for the murder of Damien. We are now in the transfer hearing process and because he is a minor according to the DA on Monday the judge will announce that he will stay in the juvenile detention. Because California law says we need to try and rehabilitate juveniles.
That may be the case for other minors with less charges but when it comes to this monster it is completely insane and an injustice. Just 4 months before this minor cowardly shot and killed my nephew he shot another young man and left him with permanent injuries. He was also stopped by an officer while he was riding his bicycle late at night and a 40 caliber gun was found on him with red tip bullets that are more dangerous and cause more damage to the body.
Please my family is desperate for Justice and we were told the maximum time the juvenile detention can keep him is till the age of 25 and then he will come up for parole and automatically be released. This minor will be turning 18 this month which means he would be out in only 7 years for murder. His family will get to have him back but what about us? We won’t get Damien back, we don’t have visitation rights for Damien. He is gone for ever.
Please help get Justice because this is a California law that is protecting him. We need to let the people of California know that if their family is killed by a minor they will not get Justice but rather a slap to the face on top of the pain and emptiness of losing their loved one.
