Change BACK Colorado Law to test drivers involved in any fatal accident.

The Issue

 

My son was in a crosswalk when he was tragically run over by a driver who claimed she didn't see him. This happened the night before Valentine’s Day while she was out with her husband. Despite the severe negligence in this case, the driver faced no consequences – not even a ticket.  It is unfathomable that someone can cause such a devastating loss and not be held accountable, especially when there were clear signs suggesting further investigation was needed. The law was changed in 2016 stating it was an infringement of rights to do a breathalyzer or any testing unless they have probable cause of impairment. 
The driver, who had  a recent prosthetic leg (a right leg), never faced testing for any substances in her system. It was abundantly clear that she was at least on prescription pain medications due to her recent condition. However, due to a flawed system, no tests were carried out, and I was met with excuses from authorities who claimed they had the training to "know" she wasn't under any influence, which echoes as gross negligence.

To add insult to injury, the detective falsely claimed that my son probably had alcohol in his system on the police report, which autopsy results categorically disproved.

This failure of justice is not just about my loss; it’s about preventing this from happening to anyone else. Colorado must implement a mandatory law requiring comprehensive testing of all drivers involved in fatal accidents, irrespective of suspicion. The current situation enables killers to walk free due to lack of immediate scrutiny and standardized protocol.

The necessity for this law is beyond question. It is an imperative action for the safety of our community and to ensure that justice is duly served. We aim to prevent any family from enduring the agony of knowing that their loved one’s life was taken, and nothing was done to hold the responsible party accountable.

By putting this law in place, we can ensure that every tragedy on our roads is given the thorough investigation it deserves, providing families the closure they desperately need and preventing future acts of negligence from going unchecked.
