This law in question is in violation of several Amendments to our Constitution - namely Amendment VI, Amendment VIII, Amendment IX, Amendment XI, and Amendment XIII. Under this law, those found guilty of first-time traffic violation offenses can be subjected to severe repercussions, including a criminal misdemeanor charge, one-year imprisonment, six months of license suspension, and fines up to $2500, even when no harm, damage, or death has occurred. All evidence seems to be unjustly weighed in favor of the State.
Implementing such stringent rules for first-time offenders, with no account of the severity of the offense, undermines fairness and justice. Moreover, the blow this law deals to an individual's life - the interruption of livelihood, the financial strain, and the undue criminal record - is disproportionately harsh.
