Challenge Changes in Laws Prohibiting Tow Truck Licensing

The Issue

This issue is deeply personal to us. We fully acknowledge the importance of ensuring public safety and maintaining high standards within the towing industry. However, we firmly believe that having past criminal records should not automatically lead to disqualification when obtaining a tow truck license. Many such individuals have shown dedication to their reform, proving themselves to be responsible, law-abiding citizens. The recent legislative changes that have made it impossible for tow truck drivers with past criminal histories to obtain or renew their licenses have had a devastating impact.

We understand the importance of ensuring safety and security in the towing industry, but we believe that individuals with a past criminal record should not be automatically disqualified from obtaining a tow license. Many of these individuals have turned their lives around and are now responsible, law-abiding citizens who are fully capable of safely operating a tow truck.

These individuals have been denied their Certificates without the opportunity to appeal, putting established businesses at risk of closure. If this trend continues, by July 1, 2024, many experienced Tow Truck Drivers may lose their jobs and ability to support their families due to past criminal records, leading to a rise in unemployment rates in our province.

Furthermore, the lack of appeal options for license denials goes against section 2(e) of the Canadian Bill of Rights, which guarantees the right to a fair hearing for the determination of rights and obligations. Our legal system is built on principles of rehabilitation, yet seasoned Tow Truck Drivers are facing the loss of their only source of employment due to a new law that prohibits them from working based on past transgressions.

Our plea is to review these law changes that have affected many people devoted to the towing industry and marginalize those who demonstrate commitment to change. These laws no longer reflect our modern understanding of rehabilitation, growth, and forgiveness. Hence, reform is overdue. 

Let's stand together to challenge this law, advocate for those determined to change their lives for the better, and celebrate the contributions of these individuals to our local communities and the towing industry.
