In a very sweet victory for used car buyers, a 3-judge panel ruled that CarMax has been violating California's Car Buyers Bill of Rights. The law requires dealers who advertise that they sell "certified" cars to provide a "completed inspection report" about the condition of each of the components they inspect. However, for over a decade, CarMax has failed to provide that information. Instead, CarMax merely provided a generic list of components, and placed it in the glovebox. That makes the inspection report virtually worthless. The 3 judges in the U.S. Court of Appeal, 9th Circuit, ruled in favor of Travis Gonzales, who purchased a 2007 Infiniti G35 from CarMax in Costa Mesa, CA. Soon after purchase, he started experiencing problems with the brakes, windows, transmission, and engine, and the "check engine" light and other warning lights kept lighting up. During the oral arguments in the case, Judge Wardlaw told the attorney for CarMax: "Counsel, I have to tell you that having read what CarMax does, I told both my children, don't you buy a 'certified' car from CarMax..." We agree -- very good advice!!!
