It's been a while since we updated you. Apologies, but since Armando's Planning application failed there has been a lot to do.
The whole point of our campaign has been about Armando getting on with his life without interference from neighbours attacking his culture and lifestyle, illegally supported by council workers. Today he is living among friends, but still isn't fully able to exercise his right to use his property. This is despite the assurances of the law, council policy and housing officials and due to the disconnect between services operated by Canterbury City Council.
The second point of our campaign has been to speak out about the neighbour bullying and Nimbyism encountered by like minded people in Armando's community. People who contacted this campaign confirmed - it isn't just about him. Neighbour bullying, characterised by anonymous complaints, followed by unexpected visits from ill informed and over empowered council workers, creates an atmosphere of fear that affects everyone - as Armando found out.
We know there are social and economic reasons why what happened should never happen again.
Where we are now - Armando:
Due to inconsistencies in the planning process as it was applied to his recently refused planning application, and certain statements by East Kent Housing in respect of checking that planning permission would be available where he was being moved to, a case has been opened up with the Local Government and Social Care Ombudsman.
A planning appeal has been lodged.
For Armando, bizarrely his treatment by the councils housing service includes the disappearance of a vital part of his equipment - last seen in council hands. That's not all - there is eight years of stressful bureaucracy and neighbours controlling and blocking his objectives to get over.
For legal reasons we can't discuss much about how his cases are going but its worth mentioning that in respect of his planning appeal it has been uplifting to have the positive feedback of the planning team at the Radio Society of Great Britain, after we (as lay people) prepared his appeal.
There is further light at the end of the tunnel. As we explored the issues affecting Armando we discovered which policies were used to abuse him.
Where we are going:
The Policy which affects the issue most, is the National Planning Policy Framework 2012.
On 12th March the secretary of state for communities and planning opened up a public consultation about a newly drafted version of this policy. This goes on until May 2018.
We were able to contribute to that consultation, by reflecting the issues that affected you. We were also able to highlight and consult with the RSGB on the areas where the policy currently falls down for us, to influence their contribution.
Fortune Smiles. The revised policy as it stands is a welcome change and if all goes well, we will be able to close the campaign on the strength of it, having made all of our points.
In the mean time we continue to work with Armando during his planning appeal, the complaint about his treatment, his quest for justice, and just getting on with his life.
