The Issue

STOP AB 828 - A Dangerous Bill That Targets Landlord Rights.   

AB 828 (Ting) Seeks to Impose 25% Rent Reductions,
Prohibit Most Unlawful Detainers (i.e. Eviction Moratorium) & Add New Renter Protections Justified by COVID-19 Related Assumptions.

AB 828, along with the April 6th ruling by California Judiciary Council, are a blatant abuse of power that strips landlords of their livelihood and all their legal rights!   At the same time renters unions are demanding rent forgiveness.  Immediate action is needed to protect landlords - Stop this bill now!   STOP AB 828!   Your vote is needed.   If you agree, please sign this petition.  
 
Covid-19 has undoubtedly created a financial challenge for renters and many others.  And AB 828 is the wrong solution.  It is unfair and unreasonable to shift that financial burden to the landlord, many of whom rely on rent as their sole source of income.   An eviction moratorium and forced rent discounts directly impact the landlord’s ability to meet their own financial obligations, particularly for smaller residential landlords.  It is not realistic for landlords to finance or even manage long term repayment plans.  Meanwhile, landlords must continue paying their mortgage, insurance, taxes and utilities as well as maintenance/repairs.   

There is only one viable solution!  Give renters what they really need:  A government run "Emergency Rent Relief Fund" to provide vouchers consisting of grants & low-interest loans used to directly pay their rent.  If we don't find a more equitable solution immediately, the result will widespread devastation with landlords in financial ruin or perhaps homeless, followed by chaos in the courts, a reduction in available rental housing, a repeat of the 2008 mortgage crises, and the final ripple effect in the housing & financial markets. 

If AB 828 passes it would:

  • Allow for Judges to issue 25% rent discounts to residents. 
  • Create payment plan scenarios where residents pay an amount not to exceed 10% of the balance due each month until the past due rent is paid in full. 
  • Leave owners to pay for all legal expenses incurred during the unlawful detainer process, preventing you from sharing this expense with a non-paying resident. 
  • Allow for Judges to interpret and establish what an economic hardship is both for you and your residents.

Our politicians need to get on the right side of history before it's too late.  The politicians that are promoting these authoritarian mandates & bills must be stopped!   If we don't stop them now, their regulations will continue far beyond Covid-19 issues.  We will all remember this in the next election!
