Petition to contest, investigate for election fraud, call for second election of the December 11, 2022 Election and declare it as Failure of Election with conspiracy and malicious intent to commit election fraud for the registration of board of directors/trustees and officers of of Cabuyao Major Homes Homeowners Association Inc. (CMHHAI)

Also, a call for a second election or removal/invalidation of anomalous elected officials as per amended bylaws of Homeowners Association.

We, the undersigned homeowners* of Cabuyao Major Homes Homeowners Association Inc. (CMHHAI), respectfully request that the recent election held in December 11, 2022 8:00AM to 5:00PM (Manila Time) be deemed a failure of election due to the following reasons:

1.  Only 214 out of 585 homeowners participated in the election, constituting less than 50% of the total number of homeowners in good standing. In contrast with the claim of only 355 total qualified voters. Those the election committee disqualified as voters under Nelia Maron did not undergo proceedings for delinquency as per section 17 of the 2021 Revised IRR of R.A. 9904. No written demand letter was issued for those they deemed delinquent and/or not in good standing because of non-payment of dues and even the water bill balances was also considered in the screening process for qualified voters.
2. Those claiming as incumbents from the supposed to be a failure of election were able to submit requirements to DHSUD and be received, with the assumption of the department that those notarized documents were furnished in good faith.
3. The low voter turnout and the questionable registration of the candidates along with the campaign call into question the legitimacy of the election and its ability to accurately reflect the will of the homeowners, while the election committee themselves ignoring such turnout.
4. Allegation of election fraud with persons that are not homeowners nor representative of the homeowners' household. Persons esp. tenants without voting power using fake residential address/es participated in the December 11, 2022 HOA Election.
5. Few of the presumptive elected officers are delinquent in standing proven by their deficiencies in payment of monthly dues and/or not representative of the homeowners' household. This is irregardless of the procedures in section 17, as the qualifications for directors and officers stated their delinquency in non-payment is a commission of conduct inimical to the interest of the association.
6. Conflict of interest with the Election Committee chair Nelia Maron is campaigning for her son James Vincent Maron.

We request that the Election Committee of CMHHAI, in coordination with the regional office of the Department of Human Settlement and Urban Development Region-IVA Calabarzon (DHSUD R4A Maasahan), investigate these issues and declare the December 2022 election a failure of election. We also request that a new election be held as soon as possible to ensure that all homeowners have the opportunity to participate and that the elected officials truly represent the will of the community.
