California State Penal Code 21957 reads: "No person shall stand in a roadway for the purpose of soliciting a ride from the driver of any vehicle."
NOTE: California Vehicle Code section 530, provides that: "A "roadway" is that portion of a highway improved, designed, or ordinarily used for vehicular travel-- this INCLUDES shoulders of highways.
It is OUR conclusion, the undersigned, that shoulders of roadways must be reserved for hitchhiking in case of emergencies for all American citizens, & that NO CITIZEN should be without the right to express their need to obtain safety when stranded.
Hitchhiking in California must be legalized for several reasons. Some of them include:
1.) Hitchhiking uses less gas than each person owning their own vehicle, & people should have the right to use less gas & to help each other do so. Restricting people's personal choices to either hitchhike or pick up hitchhikers is a violation of people who are "conscientious objectors" to the excess consumption of oil.
2.) Restricting peoples' ability to travel safely in modern times long distances to only people who can afford a vehicle & its financial upkeep as well as those who can afford public transit is a form of discrimination against impoverished citizens, who are often only able to travel via hitchhiking-- especially in emergencies.
3.) Hitchhiking promotes togetherness of spirit, & involves a person in need as well as a good samaritan. People in America ought have the religious protection to express their need for a ride (a form of protection that ought be protected by the first amendment) & also to express their will to help those in need. To bar this communication between victim of circumstance & those who want to pick up hitchhikers is a violation of both parties' political & religious protections as ensured within the bill of rights.
4.) Using less gas can help reduce gas prices for everyone, & also helps mitigate environmental damages believed by many people to be associated with the consumption of fossil fuels. The American People reserve the right to express their personal needs to fulfill that which they feel to be right.
5.) The need to hitchhike can happen to anyone for a number a reasons, & should it happen to someone without water, not having the option to hitchhike could expose a person to heatstroke or exhaustion if they are caught without water in an isolated situation. This is a serious safety issue.
