The Issue
These are actions that need to be taken by this university to improve the system of handling rape and sexual assault cases:
-
There needs to be more Title IX documentation education. Everyone involved in the process of a Title IX investigation needs to be fully informed of how, why, and what things matter and how to do things crucial to this process.
-
There needs to be a 60 day max limit on when a hearing needs to happen. Waiting 125 for a hearing to happen is unacceptable.
-
There needs to be a Title IX team, not just a single coordinator. By having a team, this provides an opportunity for a less biased proceeding with more than one viewpoint judging the investigation. The Victim Advocate, Student Affairs, University Police, and other people need to be on the Title IX team to make sure the survivor is constantly informed about the proceedings and being supported and cared for.
-
The Title IX document needs to be reformed to be more clear. What is a “reasonable request?” What counts as a “forcible rape?” There is never different levels of how valid a rape is, this needs to be made clear in the documentation.
-
The Victim Advocates need to support the survivor every step of the investigation and hearing process, not just the first week. It is very hard for a survivor to reach out, so the advocate needs to be there to speak out for the survivor when they are feeling overwhelmed.
-
For incidents that happen off campus, there needs to be a clear set of procedures to follow to help the survivor file properly with the county police department because the university police do not have jurisdiction.
-
The location of the rape kit must always be know by the survivor and should be kept in a secure location where it can’t be misplaced.
-
There needs to immediate access to resources for off campus counseling and health services in case the survivor doesn’t feel comfortable using the on-campus resources.
-
More mandatory education for the whole campus community about sexual assault and rape needs to happen. The online education module is not enough. The entire campus community, both male and female, should be well versed in what to do if they are raped. Campus needs to understand what consent is.
-
There needs to be a coalition of students, staff, and faculty that oversees the Title IX cases to make sure they are handled fairly.
- Any policy changes in regards to sexual assault and Title IX need to go through the coalition mentioned above.
