Camera picturetaking and videotaping punishment law in Korea should be cancelled, abolished, abandoned, and banned forever now.

There is very strange and unequal law which is mostly applied to Korean man nowadays as the following.

Special Act on Punishment of Sexual Crimes

Article 14 (Shooting with a camera, etc.) 

(1) A person who shoots a body of a person who can induce sexual desire or shame by using a camera or other similar mechanical device against the intention of the person to be photographed, shall be punished by 5 years of imprisonment or a fine of not more than 30 million won. <Amended on Dec. 18, 2018>

(2) A person who distributes, sells, leases or provides, or exhibits or displays publicly (hereinafter referred to as "licensee"), any of the photographed materials or reproductions (including copies of the replicas) Even if the shooting of paragraph 1 is not against the intention of the person to be photographed at the time of shooting, a person who has postponed the filming or reproduction against the will of the person to be photographed shall be punished by imprisonment for not more than 5 years or a fine of not more than 30 million won. <Amended on Dec. 18, 2018>

(3) For the purpose of profit, the person who committed the offense of paragraph 2 by using the information communication network (hereinafter referred to as "information communication network") of Article 2 (1) 1 of the Act on Promotion of Information Network Usage and Information Protection etc. shall be sentenced to less than seven years in prison. <Amended on Dec. 18, 2018>

This Article 14 is changed and fortified, and more section is added for this Article 14 in punishment as the following:

Article 14 (Shooting using a camera, etc.) ① A person who has taken photograph or video clip of the body of a person who can cause sexual desire or shame by using a camera or other similarly equipped mechanical device against the willingness of the person is subject to not more than 7 years of imprisonment or fine up to 50 million won. <Revised 2018. 12. 18., 2020. 5. 19.>

② A person who has distributed, sold, leased, provided, or publicly exhibited and screened (hereinafter referred to as "distribution, etc.") a photographed or reproduced product (including a replica of a replica, or even if the shooting under paragraph (1) was not against the subject's intention at the time of shooting (including the case where the person's body was photographed directly), and then a subject person who made a counterclaim against the subject's intention thereafter, that person will be punished by up to 7 years of imprisonment or a fine not exceeding 50 million won. <Revised 2018. 12. 18., 2020. 5. 19.>

③ For the purpose of profit, if a person is committing the crime of paragraph 2 by using the information and communication network (hereinafter referred to as “the information and communication network”) of Article 2, Paragraph 1, Paragraph 1 of the 「Act on Promotion of Information and Communication Network Utilization and Information Protection, etc.」, then this person will be imprisoned for three years or more. <Revised 2018. 12. 18., 2020. 5. 19.>

④ Anyone who possesses, purchases, stores, or watches photographs or copies of paragraphs 1 or 2 shall be punished by imprisonment for not more than 3 years or a fine not exceeding 30 million won. <Newly established May 19, 2020>

⑤ If the offenses of paragraphs 1 through 3 are committed through recidivism, they are weighted up to one-half of the sentence prescribed for the offense. <Newly established May 19, 2020>

Article 14-2 (distribution, etc. of false video, etc.) ① For the purpose of distributing, photographs, video, or audio targeted at a person's face, body, or voice (hereinafter referred to as "video, etc." in this Article) Any person who has been edited, synthesized, or processed (hereinafter referred to as "editing, etc." in this Article) in a form that may induce sexual desire or shame against the subject's intention, etc., shall be punished by imprisonment for not more than 5 years or by a fine not exceeding 50 million won.

② A person who has made a return to the edited matter, a composite, a processed product (hereinafter referred to as "edited matter, etc." in this section) or a copy (including a duplicated copy of the replica; hereinafter the same applies in this section) or edited in paragraph (1). At the time of doing such, even if it was not contrary to the intention of the subject, such as a video clip, a person who postponed the edited material or a copy against the subject of the video clip, etc. afterwards, shall be imprisoned for not more than 5 years or imprisoned by a fine not exceeding 50 million won.

③ For the purpose of profit, anyone who commits the crime of paragraph 2 using the information and communication network contrary to the intention of the subject, such as a video, shall be sentenced to seven years or less.

④ If the offenses of paragraphs 1 through 3 are committed through recidivism, they are weighted up to one-half of the sentence prescribed for the offense. <Newly established May 19, 2020>

Article 14-3 (Blackmailing / Coercion using Photographs, etc.) ① Any person who threatens a person by using a photograph or a copy (including a copy of a replica) that can cause sexual desire or shame shall be punished by imprisonment for more than one year.

② Any person who interferes with the exercise of a person's right or causes an unduly job by threats under paragraph 1 shall be punished by imprisonment for three years or more.

③ If the offenses of paragraphs 1 and 2 have been committed through recidivism, they are weighted up to one-half of the sentence prescribed for the offenses.

Article 15 (Unconvicted) Non-convicted persons in Articles 3 to 9 and in Articles 14 and 14-3 shall be punished. <Amended May 19, 2020>

Article 15 (Unconvicted) Non-convicted persons in Articles 3 through 9, 14, 14-2 and 14-3 shall be punished.

These were done by Deobuleuminjudang, which become unruling party of Republic of Korea now. Also the main person who suggested and enacted these kinds of law recently was Baek, HaeRyeon. These Special Act on Punishment of Sexual Crimes in Republic of Korea is supported by Nth Room enactment and department of (women) gender and family equality, Korean President Moon JaeIn, women's organization about 7000 in numbers, feminists in Republic of Korea. They had big show and protests in TV with pickets before 2020. 4.15. National Assembly member Election Day in Republic of Korea.

The lady who is videotaped on my video clip which convicted me had a very formal casual attire which had 70s or 80s my mother's coat type, and she had a face of Japanese or Chinese warrior who is only concentrating using cell phone listing to music with her earphone. She wore shoes which have strings and attach-and-detach type fastner. Also she had beige pantyhose. I tried to look her legs to check whether it had shiny look, but it didn't. So I decided to videotape her whole body in subway station to check shine of her pantyhose again. Also this lady's whole fashion give me a lot of interest because I thought I could use this video clip for cosplay what I used to do. 

Before this happened, a guy who looked my cell phone like penetrating manner was staring continuously what I was doing. He moved his body in 45 degrees right and left by 1 second interval like dancing manner and with a smiling face and grabbed and snatched my cell phone abruptly. I was thinking this guy was joking with his action, but he told me in Korean Jeollado dialect language "You are f**ked, a**hole." I was very friendly for his watching manner because nobody was showing interest for what I am doing in subway train. Then I asked him "Please give me my phone back" in a gentle word and manner. He refused with words in Korean Seoul language, "Let it go, you motherf**ker."

I was thinking something very bad thing is happening to me at this time, and a roar of fire and power downing feeling is coming through my chest and legs, I begged him. "I am sorry." Later I found this kind of sorry words should not be said to the reporter for my incident at this subway situation because everything is disadvantageous to me. Also I found that this guy who reported me to station and police was one of the defectors family from North Korea, and he attended Korean police college located in Korean University. They came about 12 years ago and this guy is about 24 years old at this year 2020.

This guy called station manager who is two stations away after this incident by SOS device located far right of my seat. I went to that station and waited. Finally 3 policeman came and said to me, "Mr. BoRam Kim, you are arrested." I am wondering how they found my name because I didn't have police record at that time. However, nobody handcuffed me, and I went out by myself to station exit, and nobody followed me. I got into police car which had three young Korean officers in there. I told them that present policemen are elite than old policemen." The lady who looked like in her 20s didn't look what was happening in that subway and left the scene before one station which office that I went to.

I went to police dispatch center and they give me statement paper. I didn't know what to say, so I wrote "I mistakenly videotaped the person in front my seat and please give me my phone back. I will not do this kind of thing again." They also give me Miranda warning signing paper which I didn't recognize as it is because there was no word for Miranda warning on that paper, and I mistakenly signed on that paper even though I didn't get that Miranda warning at all. I was scared of the following situation to sign the Miranda warning statement paper also.

At that time another guy is warned by policemen because he tried to appeal his situation, and Korean policemen told that they will confine him in police jail if he appeals again. Finally they deprived his possession which are screwdriver and cutter knife when he said to them again, "Please listen to word I am saying." They cuffed him with five policemen and pressed him with their bodies and took him in certain place. Still the Korean policemen are inhumane to male offenders but friendly to women offenders. Korean women are punished only half of Korean men's punishment amount, or women are not punished at all even if they are convicted. 

I was moved to police station and forced to write police investigation paper with my answering. The investigating officer had a forcing manner that I did wrong. I denied but he told me I did wrong. So most of that paper contents had statements that I did wrong.

I am on a second trial with this law of article 14 #1, the police college student who reported me was witnessing in Korean court, and prosecutor and judge were all women. The prosecutor and judge trusted his word fully. They ignored my word and my attorney's evidence and appealing documents. The first sentence came out against my convicted 4 seconds video clip as 9 million won fine and ten years picture registration in police station, sexual violence prevention program education 80 hours, 3 years hiring ban in children and youth related organizations, which means I become a convict, and this is the most ridiculous law that I have ever seen in my life because this law exists only in South Korea. This is because feminism, department of (women) gender and family equality, and women's organizations rules over Korean constitution, Korean government, and Korean president nowadays.☹️

Because of this law, five people were dead as defendants in criminal cases. Two were fallen from high building, two were strangled to death, and the other were dead with unknown reason. The person who was dead recently was writing bible pages every day for his repent.

Once again, camera picturetaking and videotaping punishment law in Korea should be cancelled, abolished, abandoned, and banned forever now. Also Women's violence prevention basic law should be perished and banned right now because there comes a lot of coordination feminism law comes out recently in Korea. It includes Varied Camera Device Controlling law also, which means nobody is allowed to take pictures or video of other people.
