The Issue
To Whom it May Concern,
We, the undersigned residents of Cardinal Pointe, wish to bring to your attention an issue that significantly impacts our properties and daily lives. Under the current rule prohibiting any construction within 15 feet of regulated drainage easements, many homeowners are unable to fully utilize and secure their property. This restriction leaves a substantial portion of our yards unusable to family / pets, reduces our privacy, and limits our ability to enhance the safety and aesthetic value of our homes. For those with small properties, this rule can render large sections of their land virtually unusable, negatively impacting the value and enjoyment of their homes.
if the current rule remains unchanged, homeowners will continue to face these challenges, which detract from their quality of life and property value. However, if the policy is revised to allow homeowners to build fences within these easements, provided they take full financial responsibility for any removal or restoration costs if the city needs access, it will offer a fair compromise. This change would enable homeowners to secure their properties while ensuring that the city's access to drainage easements remains unobstructed. This flexibility would empower residents to make the best use of their land while still respecting the city's operational needs.
We urge the committee to consider this request with the seriousness it deserves. Immediate action is necessary to resolve this issue that affects so many of your constituents. By revising this rule, you will not only address the current frustrations of homeowners but also demonstrate a commi9tment to supporting property rights and community well- being. We believe this change is a reasonable and mutually beneficial solution that will lead to a safer, more secure, and harmonious community.
