This petition asks that the Bloomington city code be amended to allow ducks to be kept on residential property of less than one acre, following the same guidelines that have been established for chickens. 

The current city code, updated in 2019, outlines the restrictions for chickens and other poultry in Chapter 12, Division D, in the following two passages:

  • (a)   Limitation on the number of chickens. No person shall keep on any single-family or two-family residential property more than four total hen chickens. This is in addition to the maximum of four domestic animals or pets.

AND

  • (3)   Owners of one acre lots may have four hen chickens, meeting all of the requirements set forth in § 12.115, or farm poultry, such as, but not limited to, ducks, geese, turkeys, pigeons, swans and doves, and shall have no more than four farm poultry meeting the requirements of this section.

We understand this to mean that any resident of Bloomington may keep up to four chicken hens, but that at least one full acre of land is required to raise ducks. We feel that this specification is unnecessarily strict and would like to either appeal for the ordinance to be changed.

Of the animals listed in the charter, chicken and ducks are easily the most similar. They are typically of comparable size and temperament, eat the same foods, require similar amounts of space, and are often raised together in a shared environment. Many experts even recommend raising ducks as an alternative to chickens, as they are often friendlier, less destructive to lawns and gardens, less susceptible to common diseases, and much more resistant to severe temperatures. Unlike chickens, domestic ducks are also unable to fly, and therefore less likely to escape. While geese, turkeys, and swans are much larger and require very different conditions, chickens and ducks are similar enough in all respects that we believe there is no reason for the city to draw a distinction.
