Block Case 2021SP-089-001 to rezone property at 1705 Hayes St from MUI-A to SP

The Issue

Rezoning parcel 464 (1705 Hayes St) to allow the construction of a 24 story building proposed by Cherry and Associates will significantly strain city resources in our area. This neighborhood simply cannot accommodate another 295 residential units and 350+ cars at rush hour, especially when there is already another 24 story high rise going up within a 1 block radius (The Avalon Midtown), which will bring yet another 300+ residential units online and another 350+ cars.

We don't have the infrastructure to support additional roadside traffic that will be generated by the new units proposed for 1705 Hayes. Our highway onramps are already severely congested at rush hour, and 17th + 18th ave gets backed up all the way to Hayes St when going left onto West End Ave during busy times.

Most of the individuals signing this petition are residents of the Broadwest building, directly across the street from 1705 Hayes. Construction of the proposed 24 story Building at 1705 Hayes Street will create privacy concerns for existing residents due to the shallow 100-150 foot offset from the west side of the Broadwest residential tower. Furthermore, obstruction of Broadwest residents' windows will devalue their units by $20k to $150k per unit—as calculated by previous property sales with obstructed vs unobstructed views in Broadwest.

Several residents who live in the area have also voiced concerns about whether the land could accommodate three high rises within 1.5 city blocks, from an engineering perspective. Broadwest has already excavated 7 floors below ground, and we are concerned that the construction of high rises nearby will create a safety risk due to an improper survey of the soil. Settling that is caused by the construction of new high rises could risk structural damage to the Broadwest tower, or in a worst-case scenario, settling and disruption to the surrounding grade could cause Broadwest to collapse.

Finally, high rise construction in this area will pose safety risks for residents who currently live here, and it will reduce the walkability of the neighbourhood for current residents. 17th Ave cannot accommodate the construction vehicles and cranes required to build 1705 Hayes while also allowing current residents of 1616 West End Ave to enter and exit their building & parking garage without significant disruption.

This petition asks that the request to rezone 1705 Hayes Street via Council Bill No. BL2022-1154 case 2021SP-089-001 be denied in order to protect the property values of existing residents in the area, reduce traffic congestion, maintain privacy, and ensure safety. Parcel 464 was originally zoned to permit a building with a maximum height of 15 stories, and we do not feel that this rule should be amended for any reason to favour Cherry and Associates.
