As a concerned Homeowner, an issue has arisen which requires your immediate attention.  As you may or may not know, personal indifferences that have arisen from neighbor on neighbor disputes, in particular amongst recently resigned HOA President, Eric Taub, Treasurer Arthur Zahrecyin, and Director, Joyce Miller all of whom live on Creekside Dr., has spilled over onto and have been directly affecting the day to day operations and functionality of the Black Diamond HOA Board. This affects all Homeowners.  This specific Petition calls for the immediate removal of the Treasurer and recently appointed Secretary, Authur Zahrcyin ("Mr. Zahrcyin").

In accordance with Florida Statute 720.303(10)((a)1), "...any member of the Board of Directors can be removed from office with or without cause by a majority of the total voting interests."(http://www.leg.state.fl.us/statutes/index.cfm?App_mode=Display_Statute&URL=0700-0799/0720/Sections/0720.303.html Your vote is important. That means we need 238 votes. 

Immediately following the unexpected resignation of two (2) of the Black Diamond HOA members, Eric Taub (President) and Cliff Naparsteck (Secretary), an abuse of power, and disregard for our HOA governing documents and procedures by several members of the HOA Board, in particular by Mr. Zahrcyin.  Following a scathing letter from our well-respected  HOA  attorney Michael Gelfand (https://www.dropbox.com/sh/a1jqcsd9yb18ciw/AAAWSeTpj-RIPFOMuQsLX-xca?dl=0 whereby Mr. Zahrcyin was mostly the focus, an illegal closed meeting by the Board fired our HOA expert Attorney, Michael Gelfand. 

Let it be known that Mr. Zahrcyin and other certain board members, failed to follow proper in the process of firing Mr. Gelfand. This  includes but is not limited an unauthorized board member waiting for property manager Renata to leave for day and  entering the property manager's office on February 5, 2021, taking and keeping the key to the locked bulletin board for several days and changing the previously agenda with one that met their agenda.  Ironically, Mr. Zahrcyin was also instrumental in vetting the newly appointed attorney that replaced Mr. Gelfand.  The vetting of the new attorney violates procedure, and sidesteps the duties of the property manager who independently is supposed to bring outside vendor/attorney to the Board for consideration. In essence Mr. Zahrcyin unauthorized vetted and eventually had the present law firm of Frank, Weinberg and Black retained. The actions of Mr. Zahrcyin are unacceptable as such he needs to be removed from any role of responsibility on the preset Board. For as to leave him on the board would be at our community’s detriment.
