Help our neighbor save her daycare from the HOA
The Issue
My daycare is being forced to close by her HOA in Josephine Crossing (WHAT?)
Yes this is happening in our family friendly community! IT GETS WORSE The HOA Board is fining her $100 a DAY and has threatened to turn off her water!!!!
Erin Moots and Kreative Kids has been providing SAFE childcare for years and is in total compliance with the City of Billings zoning and DPHHS Licensing. Erin and her husband Michael, who is a veteran haven’t done anything wrong! They have provided safe and structured childcare!
The FOUR people who volunteered to be on the HOA are doing this- RUINING her livelihood and jeopardizing all of us parents! We are essential workers! There are three NURSES and a physical therapist that use this daycare!
This is just wrong! And they are CHOOSING to do this during a pandemic when it’s already hard to find childcare.
2020 has done enough to our kids who are confused about why they can’t go visit grandma- now the kids are getting anxiety over leaving each other and don’t understand why they can’t go see Miss Erin and Miss Jenni.
Why is this happening?
Three years ago a couple moved here from Colorado and thought it was a retirement community (Obviously didn’t do their research) **they have since moved**
They were mad that they were kids next-door and wrote a complaint letter saying:
- Kids are playing out in the pocket park
- Using chalk on the sidewalk
- Bouncing balls
- Screaming and running AND toys with noisy wheels
- Garbage smells like diapers
No joke!
The other complaints in arbitration:
- Increases traffic ***80% of the daycare kids LIVE in Josephine
- The common park isn’t available ***The daycare kids only play out there for a scheduled amount of time mid-morning before lunch and after they wake up from nap in the afternoon. They don’t just tie the kids up out there )
- Increased Garbage *** who is the garbage police? And why are they smelling and checking peoples garbage
- Impede the “quiet enjoyment and comfort” of the community ***The daycare kids are well behaved- not marching around with drums
Because of all of this the children haven’t used the park all summer. How SAD! Children should be able to play outside!
The HOA and Erin went to arbitration in July and Judge Russel Fagg ruled that “Erin may try to persuade 90% of her fellow homeowners to amend the bylaws to allow her type of business, persuade the board another variance is warranted, or move her daycare to another location.”
The 90% has to come from her HOA, but YOUR signature and the support from the rest of Josephine Crossing, our Billings Community and even our rural Montana communities should have a voice to save our hard working neighbor!
