The Petition of residents of the State of Queensland draws to the attention of the House that the building industry regulator, the Queensland Building and Construction Commission (QBCC), should be subjected to a full and frank public inquiry in relation to their governance of their responsibilities as the building regulator.
Your petitioners, therefore, request the House to conduct a full public inquiry and, as per the 2022 Independent Review of the Queensland Building and Construction Commission that the Home Warranty Insurance (HWI) Scheme be removed from under the QBCC umbrella.
The HWI should be overseen by an independent and separate entity that negates the current conflict of interest. The 2022 Varghese Report made this recommendation, but the government has not adhered to this recommendation.
There is an enormous conflict of interest for the regulator (QBCC) to have complete oversight to receive the premium’s from homeowners, assess claims, decide if they are valid and provide excessive input from their own licensee’s as to whether the homeowner’s claim is valid.
• The regulator (QBCC) requires homeowners to pay a compulsory premium (Home Warranty Insurance) for all residential construction work valued over $3,300.
• The premium is based on the price of the construction, but the QBCC advises there is a limit of $200,000 regardless of the cost of your build.
• The QBCC administers the insurance scheme, assesses claims and determines whether a homeowner is entitled to benefits under the policy. Claims are subject to eligibility requirements, time limits, exclusions, policy conditions and their decision if you have legally cancelled the contract.
• The QBCC will override a construction lawyers’ legal termination of a contract.
• Homeowners are exposed and without rights to choose. Who builds or renovates a home and only takes out $200,000 of insurance? It is like insuring your new $100,000 car for $20,000.
