What do homeowners do if the QBCC DO NOT do invasive inspections and expect homeowners to have their own report's to validate the defective works?  The system is broken and the homeowner is not protected.

QBCC - If another contractor has repaired, replaced, modified or removed the original work, the original defective work may no longer exist in the condition in which it was constructed. As a result, QBCC may be unable to determine whether the original builder’s work was defective, who is responsible for the current condition, or whether it would be fair to issue a Direction to Rectify.

QBCC also states that its inspectors conduct visual inspections and do not undertake invasive investigations to determine the cause of alleged defects. Therefore, if owners engage their own trades to dismantle, alter, replace or rectify the disputed work before a QBCC inspection, a builder can argue that:
the original work no longer exists in its original form;

• responsibility for the current condition cannot be reliably determined;
• the evidence of the original defect has been disturbed or removed; and
• it may be inappropriate or unfair to issue a Direction to Rectify based on altered work.

Tycoon Builders has concerns that the external box area may have been altered or tampered with during investigations undertaken by others, which may affect the condition and performance of the works as originally constructed.

Should any part of the works have been modified, adjusted, removed, damaged or otherwise interfered with by others, Tycoon Builders cannot accept responsibility for those alterations and will not provide a warranty for any works that have been tampered with subsequent to our original installation.
