Bring Change to Unconstitutional Incarceration and the Federal Prison System

The Issue

My name is Tony DeCaro and I am asking for your support to bring change to unconstitutional incarceration and the federal prison system. As outlined below, here is what must change: 1. Support my dad seeking a Commutation of Sentence from President Obama for his unconstitutional conviction and sentence. 2. Support that the federal courts will start allowing serious constitutional violations that render judgments void, like my dad's, to be heard. 3. Support that President Obama will commute the sentences of those, like my dad, that are currently being illegally incarcerated due to serious violations of the United States Constitution. 4. Support that Congress and President Obama will amend the Antiterrorism and Effective Death Penalty Act (AEDPA) allowing one more criterion that would allow for a judicial review at any time for a conviction or sentence that is discovered to be void due to serious violations of the United States Constitution. 5. Support that Congress and President Obama will amend the current federal prison system to allow prisoners the opportunity at a chance for parole. Without parole, most prisoners have no incentive to stay out of trouble, to better themselves, or even the hope to ever became productive members of society.My father, Rick DeCaro, is currently being held in federal prison unconstitutionally. Serious constitutional violates rendered his conviction and sentence void, a legal nullity, from its inception and the federal courts have refused to hear his constitutional issues. The court's refusal, they claim, is due to Congress' enactment of the AEDPA. Congress enacted the AEDPA and President Clinton signed into law in 1996. It was enacted, in part, due to the bombing of the Oklahoma City federal building in 1995. While I am sure many parts of the bill turned out to be good, one part turned out bad and could render the Act unconstitutional. That part is, the limits placed on prisoner's rights to file appeals. During his speech on signing the bill, President Clinton stated that it was not his or Congress' intent to deny access to the federal courts. Well, take it from my family, and possibly many other families, that is exactly what is happening. Federal Prisoner's have only two chances after going to trial to correct their unconstitutional convictions and sentences. One direct appeal and one habeas corpus petition. What happens, like in my dad's case, that the attorneys fail to discover serious constitutional violations on one of the two appeals? If you are my dad, you spend the rest of your life in prison for an offense and sentence that violates the United States Constitution. I must say, my dad has proclaimed his innocence from day one and turned down a five year plea deal because he did not commit a crime. Prior to the enactment of the AEDPA, a prisoner that discovered a serious violation that rendered his or her judgment void could file a second habeas corpus petition at any time. Since its enactment, there is only two very narrow criterion that allow for the filing of a second habeas corpus petition. (1) Newly discovered evidence of actual innocence, (2) a new rule of constitutional law my retroactive by the United States Supreme Court. Once again here is what must change and what I am asking you to support by signing this petition: 1.
