Ban the NDA — Australian Federal Reform Now!
The issue
Did you know Non-disclosure agreements (NDAs) are being used across Australia to silence workers who have experienced harassment, discrimination, bullying and other unlawful workplace conduct?
These agreements often prevent survivors from speaking about their experiences, restrict transparency, and allow harmful workplace cultures to continue unchecked.
Victoria has recently taken an important first step by restricting the use of NDAs in workplace sexual harassment cases. This is progress. But Australians should not have different rights depending on which state they live in.
There is currently no national law preventing NDAs from being used to silence victims of harassment or unlawful conduct across Australia.
Through the Ban The NDA campaign (www.banthenda.com), we are calling for federal legislation that:
• Prohibits NDAs being imposed in cases involving harassment, discrimination, bullying or unlawful conduct
• Ensures confidentiality can only ever be included at the genuine request of the complainant
• Protects individuals from retaliation for speaking about unlawful workplace conduct
• Creates consistent protections across all states and territories
Australia has the opportunity to lead with clear, national reform — rather than a patchwork, state-by-state approach.
This petition calls on:

The Hon. Amanda Rishworth MP, Minister for Employment and Workplace Relations
The Hon. Katy Gallagher MP, Minister for Women
To introduce federal legislation that ensures NDAs can never be used to silence survivors of workplace misconduct in Australia.
Confidentiality should not shield an employers unlawful conduct.
It is time for national reform.
