Ban The Awami League For Human Rights Violations And Crimes Against Humanity

The issue

Background and Context:


We, the undersigned, submit this urgent petition to the international community to demand the immediate banning of the Awami League from political participation, governance, and international engagement due to its systematic perpetration of human rights violations and crimes against humanity in Bangladesh.


According to the Office of the United Nations High Commissioner for Human Rights (OHCHR) independent fact-finding inquiry, the former Awami League-led government and its security apparatus were responsible for hundreds of extrajudicial killings, arbitrary arrests, enforced disappearances, torture, and widespread acts of sexual and gender-based violence, particularly between 1 July and 15 August 2024. These acts were carried out in coordination with state forces, including the Bangladesh Police, Rapid Action Battalion (RAB), Border Guard Bangladesh (BGB), Directorate-General of Armed Forces Intelligence (DGFI), National Security Intelligence (NSI), and violent elements linked to the ruling party.


Furthermore, the OHCHR investigation concludes that these grave human rights abuses may constitute crimes against humanity and acts of torture under international criminal law. The report also highlights the intentional targeting of civilians, students, journalists, human rights defenders, and religious minorities, violating Bangladesh’s obligations under international human rights treaties.


Key Findings and Allegations Against the Awami League:

1.    Systematic Extrajudicial Killings:
o Over 1,400 people were killed, most shot at point-blank range or indiscriminately fired upon by security forces using military-grade rifles and shotguns loaded with lethal metal pellets.
o    Many victims were children, students, journalists, and peaceful protesters.


2.    Torture, Arbitrary Detention, and Enforced Disappearances:
o    Over 11,700 individuals were arbitrarily arrested, including student leaders, opposition activists, and civil society members.
o    Victims were subjected to inhumane treatment, electric shocks, beatings, and prolonged detention without trial.
o    Security forces blocked access to medical treatment for injured protestors, further exacerbating the humanitarian crisis.


3.    Suppression of Press and Freedom of Expression:
o    Journalists covering the protests were arrested, assaulted, and, in some cases, killed.
o    The government imposed Internet shutdowns and intimidated media outlets to prevent accurate reporting.


4.    Sexual and Gender-Based Violence:
o    Women and girls were targeted for brutal sexual violence by state-backed forces and Awami League-affiliated violent groups.
o    Victims faced rape threats, public stripping, physical assault, and gender-based persecution—a deliberate tactic to silence dissent.


5.    State-Sanctioned Terrorism Against Minorities:
o    The Awami League regime orchestrated attacks against Hindus, Ahmadiyya Muslims, and indigenous communities, including the burning of homes and places of worship.
o    Religious and ethnic minorities were falsely blamed for supporting the protests and were attacked with impunity.


6.    Crimes Against Humanity and Violations of International Law:
o    The Awami League and its armed affiliates violated international human rights laws, including the International Covenant on Civil and Political Rights (ICCPR), the Convention Against Torture (CAT), and the Geneva Conventions.
o    Their actions fall under Article 7 of the Rome Statute of the International Criminal Court (ICC), which defines crimes against humanity as widespread or systematic attacks against civilians, including murder, torture, enforced disappearances, sexual violence, and persecution.


Demand for Immediate Action: In light of these findings, we urgently demand the following actions:


1.    Immediate Ban on the Awami League:
o    The Awami League should be permanently banned from political participation due to its history of human rights violations.
o    Its leaders should be barred from holding any political or governmental office in Bangladesh.


2.    Criminal Prosecution of Awami League Leaders at the ICC:
o    The International Criminal Court (ICC) must open an investigation into the crimes against humanity committed by Awami League leaders, including the former Prime Minister, Home Affairs Minister, and security chiefs.
o    Arrest warrants should be issued against those responsible for orchestrating extrajudicial killings, torture, and sexual violence.


3.    International Sanctions Against Awami League Officials:
o    The United Nations, European Union, United States, United Kingdom, and other international bodies should impose targeted sanctions against former Awami League officials, including asset freezes, travel bans, and visa restrictions.


4.    Establishment of an International Tribunal:
o    Given the failure of Bangladesh’s domestic courts to deliver justice, we call for the creation of an independent International Tribunal on Human Rights Violations in Bangladesh, modeled after the International Criminal Tribunal for the Former Yugoslavia (ICTY) and Rwanda (ICTR).


5.    Justice for the Victims:
o    Immediate efforts must be undertaken to provide compensation, medical treatment, and psychological support for the victims and their families.
o    The names of all those extrajudicially killed, disappeared, tortured, and wrongfully detained must be made public.


6.    Protection for Human Rights Defenders and Journalists:
o    The international community must provide protection and asylum for human rights defenders, journalists, and activists fleeing persecution by the Awami League and its affiliates.


The crimes committed by the Awami League represent one of the gravest violations of human rights in South Asia in recent history. Allowing this organization to continue operating without accountability would set a dangerous precedent for impunity.


We call upon the United Nations, the International Criminal Court, and world governments to take decisive action to ban the Awami League, prosecute its leaders, and uphold justice for the victims. The people of Bangladesh deserve a future free from oppression, violence, and political terror.
