BAN NON-DISCLOSURE AGREEMENTS TO STOP SEXUAL HARASSMENT IN THE WORKPLACE

The issue

The issue that is occurring in NZ around the leniency surrounding the laws involving confidentiality and non-disclosure agreements which are supported by the Employment Relations Act 2000, under the section of Good Faith Employment Relations. From this, in workplaces, confidentiality agreements (non-disclosure agreements) and sexual harassment is occurring due to the legal agreement keeping employees from speaking about about their experiences in the workplace with sexual harassment and manipulation after being pressures and coerced into signing an NDA. 

The policy/law of the Employment Relations Act 2000, under the section of Good Faith Employment Relations, needs to be influenced as it is allowing and encourages the legal ability of employers to coerce employees to sign confidential non-disclosure agreements. Whether it is confidential information about the company/business or personal relationships that must be kept confidential, non-disclosure agreements are used and legalised in the employment act which allows for sexual harassment and manipulation to occur in the work place towards women specifically where they are pressured  to not disclose information about their experiences of sexual harassment and abuse. 

Women are being bound by non-disclosure agreements which they did not want to sign while is harmful to the public and future employees as secrets are kept about the names of perpetrators as well as the details of their workplace abusive conditions. 14% of women in NZ have experienced some sort of harassment at work whether it is physical, sexual, or psychological. This statistic only accounts for the reported cases from women who have spoken out about their experiences and in New Zealand over 30% of sexual abuse, assault, and harassment cases go unreported, especially when the experiences has occurred in the work place. 

Recently in the UK the Equality and Human Rights Commission called for non-disclosure agreements in the workplace to be banned due to employees abusing the legal sexual harassment they are entitled to in their workplace. 

By signing this petition you are agreeing and supporting the cause and aim of making this policy change in New Zealand, as the UK did, in order to stop sexual abuse and harassment in workplaces that is caused by coerced signing of confidentiality agreements.
