Ban ATVs on all roads with a center line in West Virginia
The Issue
I've almost been in three accidents in the last month, being run off the road by ATV riders heading to nearby trails while traveling in packs. As a resident of West Virginia, I am deeply concerned for my safety and the safety of others who travel these roads regularly. These incidents highlight a growing problem: the increasing presence of ATVs on public roads with center lines presents significant hazards for all road users.
ATVs (All-Terrain Vehicles) are designed for off-road use and are not equipped to safely maneuver on paved roads with regular traffic. Their presence on roads with a center line, where vehicle speeds are often higher, can lead to dangerous situations, including accidents, injuries, and even fatalities. The state of West Virginia has a vast network of trails designed specifically for ATV use, but these vehicles are now increasingly venturing onto roads meant for regular cars and trucks.
For instance, a report by the Consumer Product Safety Commission found that there were over 100,000 ATV-related injuries in the U.S. in one year, many of which occurred on public roads. The Asphalt Institute also warns against ATVs on paved roads, citing their instability and the risk they pose to both their drivers and other vehicles.
West Virginia already recognizes the dangers by prohibiting ATVs on interstate highways. However, expanding this ban to include all public roads with a center line can significantly reduce the potential for accidents and increase the safety of all drivers. Such a measure would not only protect motorists but also promote safe and appropriate use of ATVs within our state's designated trail networks.
We urge the West Virginia Legislature to take action and implement a comprehensive ban on ATVs on all roads with a center line. By doing so, we can create safer roads for everyone, reduce the risk of accidents, and ensure that ATVs are used responsibly within designated areas.
