The Issue

In the early morning hours of October 17, 2025, Ava had just been granted a Domestic Violence Order (DVO) against her ex-partner. Little did she know, this was not enough to protect her from his wrath. Less than 24 hours later, Ava tragically lost her life to the same person she had sought protection from.

Ava's story is not isolated; it is a horrific narrative shared by many. Victims like her, who courageously step forward and seek Emergency Protective Orders (EPO), deserve more than just legal paperwork. They deserve a window of safety, a period where the justice system physically intervenes to protect them from their potential offenders.

Studies from the National Coalition Against Domestic Violence (NCADV) show that victims of intimate partner violence face the greatest danger during and immediately after leaving their abuser. A mandatory 24-48 hours detainment for the accused with a previous conviction in these scenarios can provide that crucial gap to relocate, seek further help, and start anew without immediate threat.

Moreover, research emphasizes that early detention could significantly reduce the chance of retaliation. Statistics reveal that around 20% of intimate partner homicide in the U.S. occurs within the first two days of issuing a protective order. By implementing this detainment period, we stand to not only save lives but support victims in their most vulnerable time.

Proponents may argue about the rights of the accused, but it's essential to balance these rights with the urgent need to protect potential victims, safeguarding them from irreversible harm.

We urge lawmakers, justice departments, and concerned authorities to prioritize the lives of these brave individuals seeking safety. Let's make mandatory detention of previously convicted offenders an integral part of the protective order process.

Please stand with us in asking for more stringent protective measures for vulnerable victims like Ava. Sign this petition to demand a mandatory 24-48 hours detainment for the accused with a DV history upon the filing of an EPO. Together, we can and must make a difference.
