The issue

 No body no parole Law;- My daughter vanished 16 yrs ago, her precious body murdered and dumped. She was never found. It sickens me - WA laws currently allow killers parole, even if they refuse to reveal where the body is.

The pain in my heart is like being stabbed with the sharpest knife, twisted over and over. Without her body, how am I to grieve, to have closure, to finally find some solace in her loss.

Disgustingly, it’s not just me in search of my child’s remains - I have been contacted by many families in a desperate, hopeless search for their murdered children’s bodies whilst the killer walks free.

They say it gets easier but not for me - the pain is still as raw as the first.

I will never stop searching for you, Hayley.

The Liberal-National Government understands that this issue is highly important to the families with missing loved ones, as well as the wider community. The principle of ‘no body no parole’ is supported, however the Government has had to introduce its own amendment to the Opposition’s Private Member’s Bill. This was because the Opposition’s proposed amendments were unworkable and created uncertainty in the parole regime. In fact, the Opposition’s Bill as it was introduced did not specify that the prisoner should be denied parole unless he or she discloses the whereabouts of the body of the deceased. It spoke instead in vague terms about cooperation with the police, raising potential interpretation problems and leaving the proposed law open to challenge in the Courts. Much has been made about the introduction and proposed introduction of similar laws in South Australia and Victoria. It is important to note that Western Australia has a different parole system to those States. In Western Australia, the Board makes recommendations to the Attorney General. In South Australia and Victoria the parole boards make decisions on parole in cases of murder and not just recommendations. In order to rectify the deficiencies in the State Opposition’s Private Member’s Bill and to provide clarity, the Liberal-National Government proposed an amendment to the Bill which would add a new release consideration to the Sentence Administration Act 2003. The new provision will require the Board to consider the extent to which the prisoner in custody for an offence relating to the death of a person has assisted in the location of the victim’s remains. The Government’s view is that this amended version of the Bill will improve the current parole system.
