Refund or Adjust excess charges paid at the time of Nursery Admission

The Issue

Many of us have kids who secured admission to nursery class for the session 2020-21. While taking the admission we deposited three months of tuition fee, annual charges and other miscellaneous charges like stationary, campus care fee etc.

The Delhi High Court in its April, 2020 judgement opined that e-education is no-child's play and efforts made by a teacher in online classes are more than those required in the physical classroom. Hence, the court ordered that schools can charge tuition fee. But what about those schools which have not provided any online classes or resources and have still charged the tuition fee. Especially in case of students presently studying in nursery, most schools have not provided any online resources in the first quarter. They may do that in the second quarter but in most schools there has not been any academic activities between the teachers and students in the first quarter.

I agree that we pay tuition fee to school during the vacations also. But in case of students of nursery, if the school is not providing any tuition through online mode then it tantamount to the fact that their session has been deferred and fee should be charged only when actual schooling commences through online or offline mode. My request is that in case where no online resources have been provided the tuition fee paid for the first quarter shall be adjusted in the upcoming quarters and other changes paid at the time of admission should also be adjusted.
