I got word last Monday that a privacy complaint has been accepted into the handling of my private information. Since my detainment in 2015 was ruled unlawful, all data collected during that time represents a gross violation of my privacy rights. Any files created from that original unlawful data collection and disseminated represents a further privacy violation. That is how I see it and that it apparently how the OIPC sees it as well. Will be interesting to see how many times that information was handed around and how many files in other government departments were started based on it.
I also filed for a correction with the custodian holding the record to have it amended to at least indicate it exists unlawfully, even if they can't legally destroy or seal the files without a court order.
Finally, I've been trying to get the Human Rights Commission to examine the file for years now, but they keep saying it doesn't fall within their mandate. I'm waiting for a final response on that now.
The health authority has 10 days to respond to the original letter from the investigator. That deadline should be up shortly. I'll post an update when I get a response.
