Appeal decision that allows S&E Properties access to Mission Hill Ln.
The Issue
Mission Hill lane is a beautiful boulevard style entrance off Hardin Valley road that was developed for the single ingress/egress to Massey Creek Subdivision by HMH Construction. The park like setting of the entrance to Massey Creek is the first appeal to all homeowners and prospective buyers. The Massey Creek bylaws require homeowners to maintain the boulevard entrance through HOA funds even though it is a public road. Current maintenance includes irrigating, mowing and landscaping contracts, as well as private lighting. We gladly upkeep this public area as it is a major influence on our property values. The Massey Creek HOA, formed in 2021, has inquired about privatizing Massey Creek and its roads, but we have been informed it is not possible at this time due to the currently proposed developments which include this one by S&E Properties. The neighborhood entrance sign to Massey Creek is located close to Hardin Valley road at the beginning of the boulevard entrance which is over fourteen hundred feet in length and over eighty feet in elevation to the first driveway on Mission Hill lane. S&E Properties has applied and been approved by colleagues to build five homes with private driveways, in addition to twenty one homes with single access to Hardin Valley rd, along the egress of Mission Hill lane. Allowing this developer to build these five homes along Mission Hill lane sets a precedent that builders may encroach on other neighborhoods even if it substantially alters the original developments character and creates safety issues for current and new homeowners. The variances requested are done so out of greed, not safety. These variances allow the developer to build as many homes as he possibly can. The current right of way along Mission Hill lane is over thirty feet and this development has received a twenty foot peripheral setback. It is not the job of any government employee to help a developer make the most of their investment. This property can and should be developed in a mindful and proper way. The best, but not most profitable, way would have an entrance to Hardin Valley rd as well as neighborhood interconnectivity to Mission Hill lane as well as the future development to the West. According to the developer’s engineer, this neighborhood interconnectivity would be extremely difficult due to the elevation of the property in relation to Mission Hill lane. This petition is asking the Knox County Board of Zoning Appeals to reverse the approval of the applicant’s colleagues on the Knoxville Knox County Planning Commission regarding the five lots along Mission Hill lane. In addition, we would like to see this parcel properly planned for the future Hardin Valley road widening with sidewalks and tree buffers to surrounding parcels. The current planning commissioners have a gross amount of conflicts of interests which leads to, at minimum, the perception of misuse of position. Intimidation and back scratching has become a very real issue amongst planning commissioners who profit from the decisions being made by colleagues. The ninety five homeowners of Massey Creek are asking the BZA to stand with us in protecting the beauty and safety of Hardin Valley. We are not asking for the parcel to not be developed, we are asking to protect Massey Creek, its property values, & our safety. Signatures of this petition are adamantly against the proposed lots 22-26 and request the Board of Zoning Appeals to deny this Use on Review which will force the developer to design a new and proper design for this specific parcel.
