Amend the law on new car purchases to include an exhange policy.
The Issue
The law says "once you sign on the dotted line the car is yours". No refunds, No exchanges. The new car lemon law bites! The Lemon Law applies to those cars that are still covered by the manufacturers original new car warranty, were purchased in MN and are used at least 40% of the time for the personal, family,or household purposes. The terms of the law are:
(1) the manufacturer has a duty to repair a car in accordance with the terms of the warranty if: the car has a defect or problem that is covered by the warranty; and the problem has been reported by the vehicles owner within the warranty period, or within two years after delivery of the car.
(2) the manufacturer has a duty to refund or replace a car that has substantial defects. Under the law, if the manufacturer or its dealer has been unable to repair a car's problem after a "reasonable" number of attempts, the buyer of a car may go through a manufacturer's arbitration program or go to court to seek full refund of the car's purchase price, minus a deduction for use of the car. a "reasonable" number of attempts is defined as:
(1) four or more unsuccessful attempts to repair the same defect or;
(2) one unsuccessful attempt to repair a defect that has caused the failure of steering or braking system, and that is likely to cause death or serious injury or;
(3) a car that has been out of service due to warranty repairs for 30 or more cumulative buisness days.
I believe we need a 1000 mile exchange policy. I bought a new 2012 car with no working tail lights or license plate light. To fix this, my rear panel and dash were removed. When the dealer repaired it they were talking about transmissions falling out and tires falling off while driving, and they were laughing about it. This really upset and frankly scared me! What if the wiring is bad and your car starts on fire? I think car manufacturers should be selling safe products and when things like this happen, the customer should be given an exchange, without it costing them more money. Please sign my petition and maybe we can amend the law on new car purchases to keep everyone safe. Please let others know about this, there could be more victims out there.
