Amend Laws to Prohibit Filming of Minors in Public Without Parental Consent

The Issue

In light of the recent, numerous troubling incidents, where minors have been singled out, filmed or photographed in public places without the consent of their parents, I am calling for urgent action. These acts are currently not considered illegal, leaving authorities powerless to take action against individuals participating in such behavior. Whilst I understand the Law cannot prosecute an individual taking photos or videos in a public setting, that may have children in the background, I would move for a change that states the INTENTIONAL filming or photographing of a minor, without consent, is a crime.

The American Psychological Association reports that children, due to their developmental status, have a limited capacity to give informed consent to be filmed or photographed, especially in instances that could potentially expose them to harm or exploitation. Despite this, legal gaps often mean the rights of minors are insufficiently protected in public spaces.

These loopholes are not just troubling, but dangerous as well. The Risky Behaviors & Safety Concerns of Adolescents in the Digital World reports that minors who have their pictures taken or filmed without consent often become victims of cyberbullying, identity theft and online predation. This disregards their privacy, their rights, and leaves irreparable damage to their wellbeing.

It is critical that we address this issue promptly, realizing the potential threats posed to our children's safety. Therefore, we appeal for an amendment in the law to prohibit the intentional filming and photographing of minors in public places without explicit parental consent.
