Amend Intestacy Laws for Separated Spouses
The Issue
My mother passed away recently, leaving no will. Her husband, who abandoned her 11 years ago for another woman, is set to inherit everything, leaving my brother and me without any share of her estate. This man, who chose to leave our family and is currently living with someone else, should not legally inherit from a woman he left more than a decade ago. The current intestacy laws are unjust and do not reflect the complexities of modern relationships.
When a married couple separates, especially in cases where the separation lasted as long as theirs did, the financial ties should be reconsidered in the event of one spouse's passing. My mother's estranged husband is not financially dependent on her and has formed a new life, yet the law still favours him over her children – her true family.
Intestacy laws need to acknowledge and adapt to the realities faced by separated families. A legal framework should be established that better considers the relationship's history, eventual separation, and the absence of financial dependence.
This issue is not unique to my family. Many are caught in a similar legal loophole where the interests of the living are not fairly represented. It’s time to press for a change that reflects fairness and equity. Legal rights should align with the moral understanding of family, recognising all significant relationships, even those disrupted by separation.
