Amend Inheritance Laws to Protect the Rights of Dementia Patients and Their Families

The Issue

I am writing this petition as a deeply affected individual, struggling with the current inheritance laws that have left my family in a difficult situation. My mother, suffering from dementia, was admitted to a care home in June 2020. My father passed away in August 2022 after battling COPD and heart failure. Before his death, he expressed in writing his wish to change his will and leave our family home to me because my mother has zero capacity due to her condition and the fact that she is in permanent care.

Despite her severe health conditions including blindness, dementia and a heart condition, and a deprivation of liberty being in place my mother's care is self-funded. Even though she cannot do anything for herself and even needs help to eat.  All of my father's savings were directed towards her care following his probate grant.

The Court of Protection has decided that the family home has to be sold to pay My Mothers Care Fees, the letter that my Father wrote has not been accepted, My Son and I have been told to move out of the property as it belongs to my Mother. We are now classed as homeless, even though My Mother also leaves the property to me in her will.

I have tried everything to save my family home, even pay a rent to continue living here and pay towards my mothers care. 

According to Age UK (2019), there are over 850,000 people living with dementia in the UK alone - an alarming statistic that underscores the urgency for change in our inheritance laws. These laws should consider the specific circumstances surrounding individuals with diminished mental capacity residing in care homes.
