Amend Florida Wrongful Death Law to Include Victims of Healthcare Negligence
The Issue
On May 14, 2022, my father's life was tragically taken by a hospital that failed him. A test scan revealed a perforation and free air, clear signs of an issue. Yet, the hospital did not address this in time. The negligence didn't stop there; they damaged him mentally and physically, and even his brain suffered from their actions. All the while, he was suffering from bowel leakage in his abdomen that led to sepsis - an infection so severe it took his life. My father suffered horribly, and the hospital doctor failed to administer any medications during his passing. They knew he was dying and that he was in so much pain but would not administer any medications for comfort. Instead, they misled his family into believing they were giving him pain meds for comfort. My father suffered so badly. All I see are visions of the tears running down my father's eyes because he knew he was dying. He knew they had damaged him, and he couldn't say one word because they had intubated him, which was placed extremely tight around his head, causing a brain injury.
The hospital then inform me he was going to die because of their negligence. They knew I could not sue due to the current wrongful death law policy in Florida.
I have reached out to several wrongful death attorneys to seek help for justice, due to the current law, I have to accept the fact that the hospital will get away with what they did to my father, which, to me, is murder. Unfortunately, on May 14, 2024, the 2-year statute of limitations will expire.
This is why I am calling for a change in these laws. The current wrongful death policy only allows certain family members ( spouses or children under age 25) and financial dependents to sue for wrongful death caused by healthcare negligence. This means many victims' families are left without justice.
We need your support to amend this policy so that any family member can sue for wrongful death caused by healthcare negligence - regardless of their relationship, age, or financial dependence on the victim.
