I am sharing my personal story to shed light on the urgent need to amend Florida's child support law regarding license suspension. I was raped by a woman who got pregnant, a traumatic event that flipped my world upside down. I reported this to the courts and the police, yet somehow, the reality of my situation felt neglected. Now, as I await a decision on disability, my abuser has not only inflicted emotional pain but has also managed to have my driver's license suspended and then put in jail due to child support. Had my license not been suspended, I believe I would have secured employment and avoided being jailed.

Under current Florida law, specifically statute § 61.13016, a person's driver's license can be suspended for non-payment of child support if the payments are delinquent. Unfortunately, this action severely hampers an individual's ability to seek and retain employment, thereby creating a vicious cycle of unemployment and further inability to make payments. This counterproductive measure fails to consider the full picture of a person's life and the complexities surrounding non-payment issues.

Research shows that suspending drivers' licenses for non-payment of child support doesn't significantly improve payment rates but rather increases the likelihood of job losses and criminal records. According to a report from the Department of Motor Vehicles, individuals without licenses have a much harder time finding employment, with transit often being unreliable and insufficient, particularly in sprawling areas like Florida.

We need legislative action to revise this punitive measure into a pathway that truly helps families. By implementing a more equitable approach, such as income-based payment plans or incentivizing participation in job programs, Florida can foster a system that supports individuals in making payments while also encouraging their ability to provide for themselves and their children.
