Amend Driving Laws Related to Prescription Medicinal Marijuana in Perth, WA
The issue
I am a resident of Perth, Western Australia who has recently lost my driving license due to the existing laws on prescription medicinal marijuana. This medication is now legal, yet the regulations around its use and driving remain outdated and punitive.
In 2016, medicinal marijuana was legalized in Australia for certain medical conditions. However, under current laws in Western Australia (WA), individuals using this prescribed medication can still be charged with a driving offence if any trace of THC (the active ingredient in cannabis) is detected in their system while behind the wheel.
This law fails to differentiate between recreational use and legitimate medicinal use of cannabis. It also does not take into account that traces of THC can remain detectable for weeks after consumption - long after any impairing effects have worn off.
The Australian Medical Association (AMA) has acknowledged that more research is needed into how medicinal cannabis affects driving ability. Yet until such studies are conducted and legislation updated accordingly, patients like myself are being unfairly penalized.
We call upon the Government of Western Australia to review these laws urgently. Let's ensure that those who rely on prescription medicinal marijuana for their health needs are not unjustly punished or stigmatized.
